Prizes
The competition winner will receive a Limited Edition lithography signed by Turning Point: Fall of Liberty creator Matt Hall, along with one copy of Turning Point: Fall of Liberty Special Edition game on a format of their choice (limited to either Xbox 360, Playstation 3 or PC).
Two Runners up will receive one copy of Turning Point: Fall of Liberty standard edition game on a format of their choice (limited to either Xbox 360, Playstation 3 or PC).
RULES OF THE COMPETITION
Competition Organiser
The organizer and promoter of the Competition is The Codemasters Software Company Limited of PO Box 6 Leamington Spa Warwickshire CV47 2ZT, UK, hereinafter referred to as "the Arranger". The decisions of the Arranger’s judging committee concerning all matters related to this competition are final.
Entry Requirements
Before entering the Competition, you will be presumed to have read and accepted the following information, Arranger’s legal notice and the technical rules and instructions for the Competitions as appearing at www.codemasters.com/turningpoint/ (“Codemasters Website”). If you fail to comply with the Rules the Arranger’s judging committee may at its sole discretion disqualify you from the Competitions and an alternate winner may be selected from the eligible entries.
The Competitions are open to anyone who can comply with these Competition Rules within the United Kingdom, Australia, Germany, Spain, Italy, France and the Netherlands. You may submit only one entry per person. No admission fee or purchase is necessary to participate.
The Competition is open from 8pm BST on 14 March 2008 to 8pm BST on 14 April 2008.
Technical Requirements
In order to enter the competition, either email us a picture of your weapon to competition@codemasters.com with the subject title "Secret Weapon", or, using an image-hosting website of your choice, post your entry in this forum thread: http://community.codemasters.com/forum/showthread.php?t=262733. If all of the required information is not given, your entry may, at the Arranger’s discretion, be considered invalid.
Winning Entry
The Winning Entry shall be determined at the sole discretion of Arranger and will be judged on aspects including, but not limited to, artistic skill, detail of design, and creativeness of the weapon idea. The Winning Entry shall be announced at 12:00pm BST on 18 April 2008
Notification of Wining Entry
The Arranger shall publish the Winning Entry’s details on the Codemaster Website. The Winning Entry will also be notified by email. The Winning Entry must acknowledge his/her acceptance of the Prize to the Arranger on or before 2 May 2008 as directed by the Arranger otherwise an alternative Winning Entry may be drawn from the remaining entries.
In the event the Arranger is unable to contact the Winning Entry by 9 May 2008 or the winner fails to comply with any of the eligibility requirements then an alternative Winning Entry will be awarded the Prize.
Participant’s personal data may be used for notifying the winner of the Competitions and publishing their names on the Codemasters Website and in the CodeM Newsletter and unless the entrant indicates otherwise may also be used to provide entrants with further information on Arranger and its products. By entering the Competitions you agree to your name and likeness, hometown, and biographical information in advertising and promotion, in any and all media without further compensation or permission, except where prohibited by law.
Intellectual Property Rights
You hereby grant and assign all rights including intellectual property rights generated from or arising as a result of the entry undertaken by you, including but not limited to copyright, rental rights, synchronisation rights, reproduction rights, distribution rights, sound recording rights, trade marks, and all other intellectual property protection wherever in the world enforceable, are hereby assigned by way of future assignment from you to Arranger and thereby shall vest in and be the absolute property of Arranger. For the avoidance of doubt, all rights in and to the name and title of the Competitions or any other proprietary right, including but not limited to the format rights of the Competitions, shall vest exclusively with Arranger.
You agree that you shall execute or cause to be executed all deeds documents and acts (including where necessary ensuring any third party does the same) to vest such intellectual property rights to Arranger.
You irrevocably and unconditionally waive (and/or where necessary ensure any third party waives) all moral rights in respect of the entry to which you may now or at any time in the future be entitled under the Copyright Designs and Patents Act 1988 (the “Act”) and under any similar laws in force from time to time. In addition, you hereby give all necessary consent required under Part II of the Act as amended by the Duration of Copyright and Rights in Performances Regulations 1995 and the Copyright and Related Rights Regulations 1996 (rights in performances) or any re-enactment or amendment thereto or under the laws of any other jurisdiction of the world to enable Arranger to make the fullest use of the rights granted to Arranger hereunder including without limitation the exploitation of the entry and by any means and in all media, or formats now known or hereafter devised throughout the universe in perpetuity.
You agree to indemnify and hold harmless Arranger against any and all losses arising out of or related to any claim that Arranger’s use of the entry submitted by you or with your consent or any intellectual property rights provided to Arranger by you infringes or violates the intellectual property rights, privacy, or any other rights of any third party,
Furthermore, you warrant that the entry submitted by you shall not contain anything which is libellous, defamatory, obscene, indecent, harassing or threatening or that you are not authorised to utilise the same.
General
The Arranger will not engage itself to any communication on the procedural issues or the results of the Competitions.
Entries are non-transferable. Prizes are subject to availability and Arrange reserves the right to substitute any Prize with another of equal or similar value. By participating you agree that any dispute with regard to the conduct of the Competitions, rule interpretation or award of prizes shall be submitted to the Arranger whose decision shall be final and binding. The Arranger reserves the right to cancel, change, modify or extend any and all aspects of this competition without prior notification to you.
No cash substitution, transfer or assignment of prizes by you will be allowed. The Arranger accepts no other liability whatsoever that may be caused by any prize awarded to any person in the Competitions.
The Arranger accepts no liability for lost, damaged, misdirected or delayed entries or any technical difficulties affecting the end result of the Competitions or the entry to the Competitions. By participating, you, and the winners, by acceptance of their prizes, agree to release and hold harmless Arranger, its affiliates, subsidiaries, and their officers, employees, agents and representatives from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses, which may be sustained directly or indirectly in connection with participation in the Competitions or with the receipt, ownership or use of the prizes or while preparing for, participating in, and/or travelling to any prize-related activity.
The Arranger expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery, subsequent use of the prize awarded and/or while preparing for, participating in, and/or travelling to any prize-related activity. The provisions of this rule may not be applicable in full or in part in some jurisdictions. The liability of the Arranger shall be limited to the maximum extent permitted by law. Prizes will be delivered to the winners within 28 days.
Neither the Arranger or its agencies shall not be responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccu¬rate, garbled or delayed electronic communications caused by the sender, or by any of the equipment or programming associated with or utilized in the Competitions which may limit the ability to play or participate, or by any human error which may occur in the conduct of the Competitions or in the processing of the entries in the Competitions. If for any reason, (including infec¬tion by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any cause beyond the control of the Arranger, which corrupts or affects the administration, security, fairness, integrity, or proper conduct of the Competitions), the Competitions are not capable of being conducted as described in these rules, the Arranger shall have the right, in its sole discretion, to cancel, terminate, modify or suspend the Competitions.

The Competitions are subject to the laws of England. Void where restricted or prohibited by law.
